These Terms of Service govern access to and use of the Nomad Dining website, inquiries submitted through the website, and bookings for private dining, culinary experiences, and related services offered by Nomad Dining.
By using the website, submitting an inquiry, requesting a proposal, or booking services, the client agrees to these Terms of Service.
Nomad Dining provides customized private dining and culinary event services. All menus, service styles, staffing, pricing, event formats, and deliverables are subject to availability, location requirements, event scope, guest count, seasonality, and written confirmation.
Information on the website, including package descriptions, pricing language such as "starting at," sample menus, imagery, and add-ons, is provided for general informational purposes and does not constitute a binding offer.
The website may only be used for lawful purposes. Users agree not to:
- Submit false, misleading, or incomplete booking information.
- Use the website to interfere with its operation or security.
- Copy, scrape, reproduce, republish, or distribute website content without prior written permission.
- Use the Nomad Dining name, branding, visuals, menus, or materials in a misleading or unauthorized way.
Nomad Dining reserves the right to restrict or terminate access to the website or inquiry channels where misuse is suspected.
Submitting an inquiry through the website does not guarantee acceptance of an event. All events are subject to review, availability, feasibility, and written confirmation.
A booking is not considered confirmed until:
- The event scope is approved in writing.
- Pricing is accepted.
- A service agreement, proposal, or invoice is signed or approved as required.
- Any required deposit or retainer is received.
Nomad Dining reserves the right to decline inquiries or booking requests at its discretion.
Prices displayed on the website are introductory or estimated figures only unless otherwise stated in a written proposal or invoice. "Starting at" pricing reflects a base level of service and may increase based on guest count, service style, staffing, rentals, travel, premium ingredients, event timing, special requests, venue limitations, and selected add-ons.
Final pricing will be outlined in a written proposal, estimate, or invoice. Payment schedules, deposit requirements, accepted payment methods, and due dates will be communicated in writing before confirmation.
Failure to make payments by the stated due dates may result in cancellation, loss of date reservation, late fees where permitted, or suspension of services.
Nomad Dining offers customized menus based on the event, client preferences, seasonality, ingredient availability, logistics, and creative direction. Sample menus shown on the website are illustrative only.
Nomad Dining reserves the right to make reasonable menu substitutions when necessary due to seasonality, sourcing issues, quality concerns, safety concerns, or circumstances outside reasonable control, provided that substitutions remain materially consistent with the intended level and style of the experience.
Clients are responsible for providing complete and accurate information regarding allergies, dietary restrictions, religious requirements, and guest food sensitivities before the event.
Nomad Dining will make a large effort to accommodate disclosed dietary needs; however, it cannot guarantee an allergen-free environment unless expressly agreed in writing. Cross-contact may be possible depending on the venue, kitchen setup, sourced products, and service conditions.
The client is responsible for ensuring that the venue is suitable for the agreed services, including lawful access, required permissions, reasonable workspace, utilities where needed, and safe working conditions for staff.
If the event takes place at a private residence, yacht, farm, outdoor venue, or other nontraditional setting, the client remains responsible for accurate disclosure of the conditions of the site, including access limitations, weather exposure, sanitation limitations, power limitations, and any restrictions imposed by the property or venue.
Nomad Dining may modify service logistics or decline to proceed if actual site conditions materially differ from what was disclosed and those conditions affect safety, food quality, legality, or operational feasibility.
Certain events may include or require third-party rentals, beverage services, florals, equipment, staffing, entertainment, or other vendor-provided elements. Unless expressly stated otherwise in writing, such third-party goods or services are subject to separate availability, pricing, and terms.
Nomad Dining is not responsible for the acts, omissions, delays, failures, or policies of independent third-party vendors.
Cancellation and rescheduling terms should be stated in the applicable proposal, invoice, or event agreement. If no separate written cancellation policy applies, Nomad Dining reserves the right to retain deposits, recover nonrefundable costs already incurred, and charge for work completed or inventory purchased in preparation for the event.
Rescheduling requests are subject to availability and may require repricing based on season, staffing, sourcing, or scope changes.
The client agrees to:
- Provide timely and accurate event details.
- Disclose dietary restrictions and allergies in advance.
- Ensure safe and lawful venue conditions.
- Obtain any necessary permissions, permits, or approvals related to the venue or event.
- Treat staff, contractors, and representatives with professionalism and respect.
- Pay all deposits, balances, and approved charges when due.
Nomad Dining reserves the right to stop or refuse service if conditions become unsafe, abusive, illegal, or materially different from what was agreed.
All website content, including text, branding, logos, graphics, menus, visual concepts, photographs, videos, layout, written copy, and creative materials, is owned by or licensed to Nomad Dining and is protected by applicable intellectual property laws.
No portion of the website or Nomad Dining materials may be copied, modified, distributed, published, displayed, or used commercially without prior written consent.
Nomad Dining may photograph or document events, food, tablescapes, or behind-the-scenes material for editorial, portfolio, marketing, social, or promotional use unless the client requests confidentiality in writing before the event and that request is expressly accepted.
Any special confidentiality, non-disclosure, or no-photography requirements must be agreed in writing before confirmation and may affect pricing or service feasibility.
If Nomad Dining offers gift cards, event credits, referral credits, or promotional offers, they may be subject to separate terms, conditions, expiration rules, blackout dates, minimum spends, or nontransferability provisions.
Unless required by law, such credits and promotional offers are not redeemable for cash.
The website and its content are provided on an "as is" and "as available" basis. While Nomad Dining aims to keep information accurate and current, it does not warrant that the website will be uninterrupted, error-free, fully secure, or free of inaccuracies.
Nomad Dining does not guarantee that any specific date, chef, ingredient, menu element, visual presentation, or service format shown on the website will be available for every event.
To the fullest extent permitted by law, Nomad Dining will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of opportunity, loss of enjoyment, or reputational harm arising out of or related to use of the website, booking requests, or services.
To the fullest extent permitted by law, Nomad Dining's total liability for any claim arising out of or relating to the website or services will not exceed the amount actually paid by the client to Nomad Dining for the specific services giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
The client agrees to indemnify, defend, and hold harmless Nomad Dining and its owners, employees, contractors, and representatives from claims, damages, losses, liabilities, costs, and expenses arising from the client's breach of these Terms, the client's negligence or misconduct, inaccurate disclosures, venue-related issues, or violation of applicable law.
Use of the website and any personal information submitted through forms or communications may also be governed by the Nomad Dining Privacy Policy, if one is published.
These Terms will be governed by and interpreted in accordance with the laws of the state or jurisdiction in which Nomad Dining is organized or primarily operates, without regard to conflict of law principles.
Any disputes will be resolved in the courts located in the applicable jurisdiction unless otherwise required by law or agreed in writing.
Nomad Dining may update these Terms of Service from time to time. Updated versions become effective when posted on the website unless otherwise stated.
Continued use of the website after any update constitutes acceptance of the revised Terms.
